CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) – Albemarle County Public Schools’ Deputy Chief Human Resources Officer Brodie Downs and Assistant School Division Counsel & Title IX Coordinator Erin Stone, as well as former Hollymead Elementary School Principal Joe McCauley, have all been charged with three misdemeanor counts of failure to report a case of child abuse, according to Virginia online court records.

All three were charged Monday afternoon in Albemarle Circuit Court, the same day former Hollymead staffer Michael Swiney was indicted on nine additional charges of aggravated sexual battery involving three additional victims. It is unclear if these additional charges are related to those cases.

Court records indicate the charges for Downs, Stone, and McCauley were issued, along with Swiney’s additional charges, by a grand jury Monday morning at 9:30 a.m. Capias warrants were issued for all four Tuesday afternoon, and Downs, Stone and McCauley’s statuses were listed as “fugitive” on the online court records as of Wednesday afternoon.

ACPD spokesperson Logan Bogert did not confirm the department conducted an operation at ACPS headquarters on Tuesday, when asked by Cville Right Now.

McCauley resigned as Hollymead’s principal in July after being placed on administrative leave the previous month. His resignation came amidst backlash following the June arrest of Swiney, who now faces 20 felony charges stemming from seven victims.

“I would never confirm nor deny personnel matters,” ACPS spokesperson Jason Grant told Cville Right Now.

During Swiney’s August bond hearing, Chief Deputy Commonwealth’s Attorney W. Lawton Tufts told the court that Swiney’s charges, at the time, stemmed from allegations made by four girls, all under the age of 13.

Tufts also said Swiney is alleged to have groomed the girls, made sexual comments toward them and showed his penis on multiple occasions.

He is also alleged to have placed his penis in a victim’s hand, touched one girl’s vaginal area above the clothes and showed a picture of his penis to a victim. Investigators found a picture of his penis upon searching his phone, but it was taken after the alleged incident.

Swiney’s next appearance in Albemarle County Circuit Court is currently set for this Friday at 1:30 p.m. It comes just week after the Virginia Court of Appeals ruled that Albemarle County Circuit Court Judge Cheryl Higgins must explain her reasoning for denying the $50,000 secured bond to Swiney in August or release him on the bond.
