CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) – Former Hollymead Elementary School staffer Michael Swiney was indicted by an Albemarle Grand Jury on nine additional charges of aggravated sexual battery involving three additional victims on Monday, Albemarle County Police announced.
Swiney, who was indicted on 11 felony charges against four victims in June, now faces 20 total charges.
“We know this is difficult news for everyone who has been impacted by this case and want to assure the community that our detectives have never stopped working on this investigation,” Captain of ACPD’s Criminal Investigations Division Michael Talbert said in ACPD’s release. “Our detectives have continued to follow new information and work diligently to move this case forward. We will continue that work and do everything within our ability to seek justice.”
This latest indictment comes just over a week-and-a-half after the Virginia Court of Appeals ruled that Albemarle County Circuit Court Judge Cheryl Higgins must explain her reasoning for denying a $50,000 secured bond to Swiney in August or release him on the bond.
If that bond had been granted, Swiney, who had been in custody since his arrest in June, would have been placed on house arrest with no access to children besides his own 10-year-old and three-year-old, and with no access to the internet other than a family computer while under the supervision of his wife, Gail.
During that August bond hearing, Chief Deputy Commonwealth’s Attorney W. Lawton Tufts told the court that Swiney’s charges, at the time, stemmed from allegations made by four girls, all under the age of 13.
Tufts also said Swiney is alleged to have groomed the girls, made sexual comments toward them and showed his penis on multiple occasions.
He is also alleged to have placed his penis in a victim’s hand, touched one girl’s vaginal area above the clothes and showed a picture of his penis to a victim. Investigators found a picture of his penis upon searching his phone, but it was taken after the alleged incident.
Swiney’s next appearance in Albemarle County Circuit Court is currently set for this Friday at 1:30 p.m.
