CHARLOTTESVILLE, VA. (CVILLE RIGHT NOW) — The court pushed back the trial date for the 24-year-old Crozet man facing charges of sexual assault, as well as filming and possessing child pornography.
Maxwell H. Mandell, who was arrested in December for sexual assaulting a child he was babysitting, will receive a seven-day trial from Sept. 21-29 with a jury sentencing.
The jury trial was initially set for June 8-12, which is still listed in online records.
During the hearing on Monday, Mandell’s attorney, André Hakes, told the judge that she and Chief Deputy Commonwealth’s Attorney W. Lawton Tufts believed the jury trial would only require the one week.
Mandell had been offering babysitting and music lessons in Albemarle County prior to his arrest.
Upon his arrest, Mandell was initially charged with felony aggravated sexual battery and felony indecent liberties with a child. After encouraging the public to report any additional information, ACPD announced in January it had identified additional victims. Mandell was later indicted on 46 charges of possessing and filming child pornography in early February.
Court documents also reveal 11 direct indictments. These include four counts of possession of child pornography on Dec. 5, the day of his arrest and four counts of filming child pornography between May 1, 2024, and Dec. 4. The indictments also include two instances of sexual penetration with a child less than 13 years old, one on July 14 and the other on Dec. 3, and a count of sexual abuse against a child less than 13 years old on March 13, 2025.
Mandell appeared in court for the pre-trial motion hearing, showing little reaction throughout the brief, mostly procedural proceedings. He has been held in Albemarle-Charlottesville Regional Jail without bond since his arrest.
