FISHERSVILLE, VA (CVILLE RIGHT NOW) — Trespassing charges have been dropped against Zachary Cruz, the brother of Parkland shooter Nikolas Cruz who was taken under the wings of Michael Donovan, former head of Nexus Services, and his husband, Richard Moore, in 2018.
Cruz was arrested in February after security footage captured the 25-year-old trespassing on the properties of Wilson Middle and High Schools and the Valley Career and Technical Center after hours.
Augusta County Sheriff Donald Smith said in a May 1, 2025, news release that Augusta County Commonwealth’s Attorney Tim Martin had entered a nolle prosequi, which effectively dismissed the charges.
“Zachary Cruz does not possess the capacity to form the criminal intent necessary to commit this offense,” said Martin. “He is now receiving services for his mental health and his intellectual disabilities. These services will do more to ensure the safety of the community than to prosecute him for these misdemeanors, for which he was not likely to serve time.”
“I fully support the decision made by the Commonwealth’s Attorney’s Office to drop the trespassing charges,” said Sheriff Smith. “Once we were able to determine that Mr. Cruz does not pose a threat, I feel this was the right course of action.”
Michael Donovan, Richard Moore and a third suspect are accused of stealing $426,000 dollars that Cruz acquired following the death of his mother. Cruz is listed as a “vulnerable adult” in the charges. Judges in Augusta County Circuit Court have agreed to postpone the case five times since charges were filed in 2022.
Donovan was briefly jailed in March after being charged with assaulting Cruz. A hearing is scheduled for May 27.
