CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) The first legal challenge to the House settlement is on its way, according to a CBS Sports report, and one of the plaintiffs is Virginia volleyball player.

Eight athletes are part of a motion to appeal the settlement, which was approved on Friday, saying the structure of damage payments violates Title IX, the national gender equity law, according to the report. That group includes UVA’s Kate Johnson.

Front Office Sports also reported the appeal and the list of co-signers, which also includes six women from the College of Charleston and one from Vanderbilt, per the reports.

A senior defensive specialist/libero from Gainesville, Fla., Johnson has appeared in 81 matches over the past three seasons for the Cavaliers. She led the team in service aces this past season.

A UVA spokesperson could not immediately confirm the report, and the attorney who is reportedly representing the women, John Clune of Colorado-based Hutchinson, Black and Cook – did not respond to an email seeking comment.

The House deal settled three federal anti-trust lawsuits brought against the NCAA claiming that the entity was violating the law by limiting the earning potential of college athletes. NCAA member schools would have to pay damages and backpay of about $2.8 billion under the terms of the settlement, but those payouts will be put on hold during this appeal, according to reports.
