CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) — Prosecutors and defense attorneys in the case of the former Albemarle County teacher accused possessing child pornography told a Circuit Court judge they needed more time to work out the details of a plea agreement on Tuesday.

Nicholas Clark, a former fifth grade teacher at Woodbrook Elementary School who was arrested March 2, is facing two felony charges of possession of child pornography. Tuesday marked his first appearance in court since a May 28 date in Albemarle General District Court.

Clark’s counsel, defense attorney Alexander Goodman, has previously told Albemarle Circuit Court Judge Cheryl Higgins that he would enter a guilty plea during the court’s June docket. But Goodman and Chief Deputy Commonwealth’s Attorney W. Lawton Tufts filed a join motion to continue Tuesday’s hearing until Aug. 27 at 3 p.m.

Goodman and Tufts told Higgins they need more time to work on an agreement.

With Albemarle County Public Schools facing scrutiny following the arrest of former Hollymead teacher Michael Swiney in June, further attention has been brought to Clark’s case. The case has been referenced alongside Swiney’s by many, including Rep. John McGuire, State Sen. Creigh Deeds, Del. Katrina Callsen and Del. Amy Laufer, who all called for an independent investigation into ACPS. The division now has a meeting planned for Aug. 4 to discuss a third-party review and investigation “related to recent events in the division.”
