CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) – Former Woodbrook Elementary School fifth grade teacher Nicholas Clark will enter a plea agreement, defense attorney Alexander Goodman told Albemarle Circuit Court Judge Cheryl Higgins during the docket on Monday.
Clark is currently facing two counts of possession of child pornography. He will appear in court on July 28 at 11 a.m. to enter his plea.
The former Woodbrook teacher was arrested on March 2 and charged with possession of child pornography and distribution of child pornography, both felonies. During his last appearance in Albemarle General District Court on Thursday, his charge of distribution was amended to a second charge of possession, as Commonwealth’s Attorney W. Lawton Tufts said there was no evidence found of reproduction or distribution.
A search warrant obtained by Cville Right Now back in March showed Clark had uploaded two pornographic videos and 12 images that appear to show an underage girl. The warrant was authorized on his Reservoir Ridge Rd. residence on Feb. 26 and conducted on the day of his arrest. Following the search, Clark was removed from his classroom and questioned by police.
Albemarle Circuit Court also set the jury trial for Rhyzon Sims, a Crozet man facing charges of rape, sodomy and abduction, during Monday’s docket. His two-day trial will take place from Oct. 28-29.
