CHARLOTTESVILLE, VA. (CVILLE RIGHT NOW) — Former Woodbrook Elementary School 5th Grade teacher Nicholas J. Clark will appear in front of a grand jury in Albemarle Circuit Court on Monday after his trial was set during a court appearance on Thursday.
Clark was arrested on March 2 and charged with possession of child pornography and distribution of child pornography, both felonies.
In his most recent court appearance, the latter charge was amended by the court to a second count of possession, as Commonwealth’s Attorney W. Lawton Tufts said there was no evidence found of reproduction or distribution.
Clark also waived his right to a preliminary trial on both charges.
He’s been held without bond at the Albemarle-Charlottesville Regional Jail since his arrest in March.
At his bond hearing just over a week after his arrest, defense attorney Alexander Goodman requested that Clark be released to his mother and stepfather on home electronic incarceration. But Judge Matthew Quatrara denied the request, saying Clark’s past “indicates the behavior of an addict.”
Tufts said at the bonding hearing that Clark had twice been banned from the messaging app Discord for downloading pornographic images and videos. Clark had also messaged and sent nudes to who he thought was a 15-year-old girl. That person was actually an adult overseas, who blackmailed Clark by threatening to inform Woodbrook of his behavior.
A search warrant obtained by Cville Right Now back in March showed Clark had uploaded two pornographic videos and 12 images that appear to show an underage girl. The warrant was authorized on his Reservoir Ridge Rd. residence on Feb. 26 and conducted on the day of his arrest. Following the search, Clark was removed from his classroom and questioned by police.
Thursday marked Clark’s first court appearance since his preliminary trial on April 23.
