CHARLOTTESVILLE (WINA) – WINA legal analyst and former lead counsel for the January 6 select committee, Tim Heaphy, tells Morning News he testified in the Colorado Trump ballot case. Heaphy said that court admitted into evidence the January 6 committee report, and he was there merely to authenticate the documents and committee findings.
Heaphy says the Trump campaign has appealed to the U.S. Supreme Court on one grounds that no trial court has found any insurrection has taken place. The campaign also contends the office of the Presidency is not one named in the 14th Amendment, Section 3. He says this is a difficult issue for the court since, unlike so many others where there’s previous jurisprudence, there is no case law here.
Heaphy says as someone who believes the former President should not return to office because of the danger he poses to democracy, he prefers if it happened at the ballot box… and a court finding in a divided country would only be blamed on a “deep state”.
