RICHMOND (WINA/FOX) – Governor Youngkin threw down the gauntlet Monday on Fox News’ “The Story with Martha MaCallum” against Virginia school districts refusing to comply with the new LGBTQ-plus school model guidelines.
“These school districts will, in fact, comply with the law, because it is the law and they don’t have the choice,” Youngkin said.
However, last month, JMU political analyst Bob Roberts told Charlottesville Right Now the model guidelines themselves are counter to 4th Circuit rulings on Title IX and the Constitution. And the guidelines likely violate state law in an amended Virginia Human Rights Act that he says states clearly that “in place of public accommodations, including educational institutions and real estate transactions, you may not discriminate based on gender identity, etc”.
Roberts says, however, there are new cases that have rendered conflicting decisions at the federal circuit level that could throw the issue back to the Supreme Court, which has not heard such a case yet.
